KSAC refuses cheques from KIA Motors
November 12, 2005
THE Building and Town Planning Committee of the Kingston and St Andrew Corporation (KSAC) has refused to accept seven cheques, totalling $668,800, paid by KIA Motors to the Council in an out-of-court settlement for constructing a two-storey unapproved building at 66 1/2 Half-Way-Tree Road, at the corner of Chelsea Avenue.
Lee Clarke, chairman of the Building and Town Planning Committee, said that the KSAC's lawyers, Bennett, Beecher and Bravo, would be instructed to take the matter back to court.
The KSAC said that sending seven cheques to the corporation, KIA Motors had breached the terms of the settlement to pay a lump sum of $668,800.
"By sending the KSAC the seven cheques, KIA Motors is dictating its own payment plan. The agreement was for the total amount to be paid at one time," Clarke said.
The building breach was scheduled to be heard in court on September 21, but KIA Motors agreed to an out-of- court settlement in the sum of $668,800.
Dwight Moore, the managing director of KIA Motors, told the Observer that his attorneys were dealing with the matter.
Moore, who said he was in support "of a lot of KSAC initiatives", said that he was willing to communicate with the council on the matter.
"Any issues that are unclear, I am willing to meet with the KSAC and to seek to address them," he said
