Cop wins case against commission

Well-known crime fighter Inspector Donovan O'Connor has won his legal battle against the Police Service Commission to retire him in the public interest.

O'Connor, 47, popularly called 'Hux', was retired in the public interest in December 2005 following 35 complaints made against him.

He took the issue to the Judicial Review Court and yesterday Justice Donald McIntosh quashed the decision.

The judge, after hearing legal arguments from attorney-at-law Bert Samuels, ruled that there was no legal reason to retire him. The judge has promised to give his decision in writing by September 18.

After O'Connor got the letter from the commission, informing him of the decision to retire him, he appealed to the local privy council which upheld the decision.

The Governor-General then gave his approval that he should be retired in accordance with Regulation 26 of the Police Service Regulations, 1961.

O'Connor went to the Supreme Court and got leave to go to the Judicial Review Court. O'Connor was on the job pending the outcome of yesterday's hearing because the Supreme Court had granted him a stay of the order.
